Legal terms and conditions for the Morrison x La Oveja Negra Motorcycle Giveaway

“[ MOTORCYCLE + HELMET + VALE MORRISON ]”

1.        Object

1.1.  In accordance with these terms and conditions (the “ Terms ”) that correspond to the organization of the raffle “[ MOTORCYCLE + HELMET + MORRISON VOUCHER ]” carried out by the company “MORRISON CLOTHING, SLU” (“ Morrison ” or the “ Promoter ”) domiciled at Calle Sancho Dávila, number 15, 2nd Floor, Door 2, and with NIF B-87.588.430, the conditions of participation in the same (the “ Raffle ”) are regulated.

1.2.           The Terms and Conditions of the Draw are available to users at the following address: [ https://morrisonshoes.com/pages/la-oveja-negra-sorteo ].

1.3.           Morrison reserves the right to make any changes to these Terms and Conditions, as well as to postpone, suspend or cancel the Draw, in exceptional cases, making public the corresponding changes through its communication channels.

2.        Stake

2.1.           Term

The period for participating in the Draw will take place from November 2, 2025 at 12:00 hours (GMT+1), until December 4, 2025 at 00:00 hours (GMT+1).

2.2.           Participants

(Yo)               Individuals who meet the following requirements may participate in the Draw (the person “ Participant ” or the persons “ Participants ”):

▪        Be over 18 years old.

▪        Follow [ @morrisonshoes and @laovejanegra.custom ]

▪        Being able to physically come and pick up the motorcycle and helmet in Madrid, Spain.

(ii)        Mere participation in the Draw implies acceptance of these Terms and Conditions.

(iii)       Participation in the Draw is free.

(iv)       Each Participant may participate a minimum of 1 time, by performing the following actions (completing all steps counts as 1 participation):

c.      Share the Instagram post promoting the Giveaway

 (v)       Morrison reserves the right to exclude from the Draw those Participants who hinder or disrupt, in any way, the development of the Draw.

3.        Awards

3.1.           The prizes subject to this Draw are those indicated below (the “Prize”):

to.      1 voucher of [€1,000] (one thousand euros) to spend at Morrison.

b.  1 Motorcycle [Royal Enfield 650 Interceptor], worth [7,500€] (seven thousand five hundred euros) .

c.      1 motorcycle helmet, worth [ 250€ ] (two hundred and fifty euros) .

 

3.2.           Under no circumstances may the products that are part of the Prize be exchanged for their cash value

3.3.        The Prize will be awarded as a whole, meaning the Winner cannot accept some elements of the Prize and decline others. Nor can the elements be substituted, altered, or transferred at the Winner's request. Furthermore, the status of winner of the Draw, and therefore the right to the Prize, cannot be transferred or assigned to any other person, under any circumstances.

3.4.           Refusal of the Award does not entitle the holder to any compensation or indemnity.

3.5 19% of the total value of the Prize will be withheld, corresponding to the applicable tax withholdings.

4.        Procedure

4.1.           During the Draw, 1 Participant will be randomly selected to win the Prizes (the “ Winner ”).

4.2.           The winner will be chosen through the Instagram platform . This platform belongs to a third party, and the Promoter has no relationship with it beyond its use for the Giveaway. The winner will be selected completely randomly, and the Promoter cannot alter the result.

4.3.           Once the Winner has been selected, the Promoter will contact them individually via email and/or direct message through the social network through which the action was carried out, informing them of their status as Winner.

4.4.           The Winner must contact the Promoter by email within a maximum period of FORTY-EIGHT (48) HOURS from the communication, to accept the prize, follow the instructions provided by the Promoter for the delivery thereof and provide any other necessary information.

4.5.           The Prize will be awarded within a maximum period of TWO (2) MONTHS from the date of the Winner's acceptance of the Prize.

4.6.           The prize products must be collected in person in Madrid [C/ Fuencarral 55 28004 Madrid].

4.7.           The expenses and procedures related to the change of ownership of the motorcycle will be the responsibility of the Winner. 

4.8.           The actual delivery of the prize will be conditional upon the Winner complying with the conditions specified in these terms and conditions and the veracity of the data provided by him to Morrison.

4.9.           The Promoter will not be responsible for the inability to contact the Winner due to having provided incorrect contact information or for other reasons not attributable to the Promoter.

5.        Advertising

With the Winner's prior authorization, their username may be publicized on the social networks through which they participated as a Winner, including the Promoter's website and their social media profiles.

6.        Reservation of rights

6.1.           The Promoter reserves the right to disqualify any user who misuses the Sweepstakes, engages in fraudulent activity, or harms other participants. Should the Promoter or any entity professionally associated with this Sweepstakes detect any irregularity or suspect that a participant is hindering the normal course of the Sweepstakes or engaging in any fraudulent activity that undermines its transparency, the Promoter reserves the right to disqualify and even automatically withdraw the Prize from any Participant who has directly or indirectly benefited from such fraudulent activity. Furthermore, the Promoter may pursue any applicable civil or criminal legal action. In this regard, the Promoter declares that it has implemented reasonable technological mechanisms and support to detect any potential fraudulent, irregular, or malicious activity intended to disrupt normal participation in this promotion.

6.2.           The Promoter is exempt from all liability in the event of malfunctions of communication networks that prevent the normal operation of the Draw due to causes beyond its control, and especially due to external acts of bad faith. It will also not be liable for transmission problems or data loss not attributable to it. The Promoter reserves the right not to award the Prize if there are reasonable grounds to believe that a participant has violated any of these terms and conditions.

6.3.           The Promoter reserves the right to make modifications or add subsequent annexes regarding the mechanics and prize of this Draw, provided that such modifications are justified or do not harm the participants, and are duly communicated to them. In the event that this promotion cannot be carried out, whether due to detected fraud, technical errors, or any other reason beyond the Promoter's control that affects its normal operation, the Promoter reserves the right to cancel, modify, or suspend it, without the participants being able to claim any liability.

7.        Limitation of liability

The Promoter will not be liable:

(Yo)               For the use of the Prize that the Winner may make or the lack of use due to non-compliance with any requirements demanded for it, such as permits, licenses, authorizations, administrative, etc.

(ii)              The company will not be liable for failures or incidents in telecommunications systems that prevent normal operation in the management or development of the promotion. Nor will it be responsible for transmission problems or data loss attributable to these systems.

(iii)             For the services that third-party companies must provide in connection with this Draw, in particular for errors or negligence committed by third-party companies that may be involved in carrying out the promotion or delivery of the prize and/or transmission problems or loss of data not attributable to it, nor for irregularities in postal shipments.

(iv)             For any error or omission in the information and data provided by the participants themselves that could prevent their identification, participation or the delivery of the prize.

(v)              Due to delay in delivery or damage, theft or loss of the prize for any reason not directly attributable to them.

(vi)             Due to the operation of the participation platform, they will also not be responsible for its privacy policy, as well as its terms and conditions regarding registration, personal data protection, and intellectual property. Users are advised to carefully read the terms and conditions before providing any data on this platform.

(vii)           For no expense, tax, levy, contribution or, in general, for any additional cost that the Winner of the Draw must incur to receive the Prize.

8.        Personal data protection

8.1.           Obtaining personal data and the data controller

In accordance with current regulations on the protection of personal data, the Participant is informed that the personal data provided to Morrison within the framework of the Draw will be processed, with the entity responsible for said processing being “MORRISON CLOTHING, SLU” located at Calle Sancho Dávila, number 15, 2nd Floor, Door 2, and with Tax Identification Number B-87.588.430. 8.2.           Purpose and legal basis for the processing of personal data

Participation in the Draw : the personal data provided by the Participants will be processed in order to manage their participation in the Draw, and where appropriate, to inform them of their status as a Winner and to send the Prize.

Legal basis : Participant's consent. This consent may be withdrawn at any time by sending an email to the following address: info@morrisonshoes.com.

If you withdraw this consent, your participation in the Draw cannot be processed and, therefore, if you are a winner, the prize cannot be awarded.

8.3.           Accuracy and truthfulness

The personal data provided by the Participant will be considered truthful and accurate, therefore, the Participant will not be liable for any damage that the lack of truthfulness and accuracy of this data may cause.

8.4.           Personal data of minors

Those under 18 years of age may participate in the Draw, therefore their personal data will not be collected except with the authorization of their guardians.

8.5.           Personal data retention period

Personal data will be kept until the statute of limitations has expired for any actions that may arise from the Draw, unless there is a legal obligation that extends the aforementioned retention period.

8.6.           Communication of personal data

Your personal data may be communicated to:

to)       Competent public bodies, State Security Forces and Corps and Judges and Courts, in compliance with legal obligations.

b)       Service providers acting as data processors.

No direct international data transfers are foreseen.

8.7.           Exercising rights and making claims

The Participant may exercise their rights regarding data protection (access, rectification or erasure, limitation, opposition, portability and not to be subject to automated individual decisions that produce legal effects concerning the user or similarly significantly affect them) by sending a communication by post to Calle Sancho Dávila, number 15, 2nd Floor, Door 2 (Madrid), or by sending an email to info@morrisonshoes.com, indicating in both cases their name, surname and attaching a copy of a document proving their identity.

Notwithstanding the foregoing, the user has the right to file a complaint with the Spanish Data Protection Agency.
